Should a couple sell the family home during a divorce?

Divorce will change virtually every area of life for a Tennessee family, and major adjustments may be necessary to accommodate these changes. In certain situations, the best choice will be to sell the family home. If this is the most reasonable course of action for a couple, careful consideration should be given to the best time to sell the home and how the couple will share the proceeds from the sale. 

Options for selling the home 

Selling a home as a result of a divorce can be a difficult and emotionally challenging process. The two parties will not only need to decide on a reasonable asking price for the property, but they will also have to do the following: 

  • Select an agent to list the home 
  • Do the repairs necessary to pass inspection 
  • Share responsibility for upkeep and mortgage costs until the house sells 
  • Negotiate with potential buyers 

A couple selling a home will also need to identify when they should list the home. Whether they list it before or after the divorce is final should be agreed upon by both sides, and there should be reasonable expectations for how that process should work.

During a divorce, a Tennessee couple will benefit from speaking with a real estate attorney regarding the sale of the family home. This guidance can provide one or both spouses with the insight necessary to make the best possible choices for their individual situation. Before agreeing to terms or making any other important real estate decisions, it may help to discuss the issues with legal counsel.
