Start moving with the proper eviction process

You’ve tried working with your tenants, but they can’t seem to abide by the lease. Sending them packing can be a complicated process, especially when they’re standing their ground on the ground you own.

If you lease out property to a tenant in Memphis, you’re more likely to have to evict the occupants than in any other city in the country. That can be difficult to do, but there are a few steps you should take in the buildup.

Moving forward

Handling disputes with tenants isn’t likely to be at the top of anyone’s list, but there are a few steps to make the process as smooth as possible:

  • Document everything: You’ll likely want to document every detail of the process. Make a note of violations and when they occurred, attempts at reconciliation, responses and any paperwork. This could all come in handy later if you need to prove anything to them, or in court.
  • Know the law: Make sure you know what you’re dealing with exactly. Laws that protect tenant rights can stretch far and wide, so it’s best to have a good understanding of your footing before you begin.
  • Send a demand letter: Sometimes, it takes things laid down in writing to help people understand their responsibilities. Give them a nudge in the right direction with a letter outlining the facts, requirements and expectations moving forward.
  • File an eviction action: If you can’t come to an understanding with your tenants, it may be time to reclaim your property. Filing with the court may be the best way to get them out and recover any back rent due.

Make sure you give yourself the best shot at a favorable outcome by knowing the law and acting accordingly. Understanding the process can make a big difference in such a difficult process.
